Belgard manages both high-volume and individual high-value judgment proceedings at District, Circuit and High Court levels as well as appeals to the Court of Appeal and Supreme Court. We provide quality advice, guidance and support throughout the litigation and recovery process.
Belgard’s knowledge and reputation in the individual courts throughout the 26 counties is unrivalled, as a result of the volume of cases we are progressing in each court on our client’s behalf.
Belgard’s debt recovery department is divided into four distinct teams:
- Belgard works closely with our clients to assess the most suitable pre-legal collections strategy and agree in advance on the content and the level of the pre-legal collection engagement.
- Belgard establishes communication with the customer and makes every effort to negotiate a sustainable repayment arrangement.
- Once a repayment arrangement is agreed upon, Belgard has the facility to set up and monitor the repayment arrangement and also to identify immediately when the agreement has been broken. Our pre-legal collection process has resulted in the prevention of thousands of cases going through the legal system.
This team specialises in recovering lower value debts in the District Court and Circuit Court and moves swiftly through the debt recovery process right through to Judgment and enforcement of same while at all times working with the customers to reach a suitable repayment arrangement.
- Our experienced high-value team specialises in recovering higher-value debts and portfolios within the High Court and Commercial Courts.
- A strong focus is placed on catering to our individual client’s specific requirements for recovery through various enforcement options and our advices incorporate a review of the judgment secured, a clear explanation of enforcement options and a pragmatic cost/benefit analysis of enforcement within the jurisdiction. - Bankruptcy petitions;
- Well Charging proceedings in respect of property;
- Instructing County Sheriffs to seize and sell assets;
- Registration of Judgments in the Register of Judgments with consequent publicity;
- Employing tracing agents to trace and verify data on debtors and their property; and
- Advising on the enforcement of historic or acquired/assigned judgments and securing leave of the court where necessary.
Unique to the Irish marketplace, Belgard also has an in-house dedicated telephony department that utilise an enterprise-level Nobel Dialler solution which is integrated through our core case management systems.
Our telephony team has a wide range of financial qualifications and collections experience (APA and full QFA qualifications) and utilising a strong focus on compliance, legal, and quality standards, Belgard devises tailored collection and recovery strategies, which operate as a dual strategy to the standard litigation process.
Belgard places a strong emphasis on regulation and regularly provides Continuing Professional Development seminars to our team on data protection, confidentiality, cyber-security, and financial fraud.
In addition, Belgard utilises a Risk Management model which incorporates “three lines of defence” as a primary means to structure roles, responsibilities and accountabilities for decision-making to achieve effective risk management and control.
